Accused dog beater faces trial in August

A man whose beating of a pit bull was captured on video and later posted on YouTube last month will face an animal cruelty charge during a nonjury trial.
City Judge E. Jeanette Ogden found David Roman, 32, competent to stand trial, said Erie County District Attorney Frank A. Sedita III. The trial is scheduled in August.
Diamond, about a year old, was taken in by the SPCA Serving Erie County.
Buffalo police Monday charged Roman, who lists addresses in Buffalo and Elma, with animal cruelty, a misdemeanor under the state’s Agriculture and Markets Law. Roman is not the owner of the dog. Authorities said he and the owner are acquaintances. The person who took the video used a phone camera and was hidden, authorities said.
